About to rent in South Korea? The most expensive risk is not always the monthly rent. A jeonse lease can tie up a very large deposit; a wolse monthly-rent lease also generally asks for a deposit. Before sending either, check who legally owns the property, what debts are registered against it and how you can protect and eventually recover your money.
Your first three requests to the agent: (1) the property's precise street/building/unit identification and current registered-title extract (등기사항증명서); (2) evidence that the named landlord can lawfully sign and receive your deposit; and (3) a complete written quote showing deposit, monthly rent, building management charge and expected move-in costs. Use an independent adviser if your deposit is consequential.
Choose the situation that fits
| You are considering | Prioritise this check |
|---|---|
| Wolse (월세) — deposit plus monthly rent | Deposit return risk and actual monthly rent, management fee, utilities and renewal conditions |
| Jeonse (전세) — high deposit and usually no ordinary monthly rent | Ability to recover all deposit, title/priority of lenders, HUG guarantee eligibility and lease registration |
| Officetel or room in multi-unit building | Whether the specific unit is legally usable as your residence and whether other tenants' claims affect repayment |
| Short furnished lease | Whether residential lease protection/reporting rules actually apply to the specific arrangement; deposit and cancellation conditions |
| Foreign resident without a Korean registration card yet | Ask which arrival/foreigner-registration and address records are needed for tenancy protection; don't assume a signed contract alone secures priority |
1. Inspect the property and the landlord, not just the photos
Request the official property registration record (등기사항증명서 / property registry extract) for the exact unit or parcel. Confirm the owner’s identity and look for mortgages (근저당), provisional seizures, security interests and other registered claims. Verify that any broker or agent has real authority to act for the owner and that the receiving bank account is consistent with the agreed payee. A broker's licence and good reviews do not automatically make a deposit safe.
What if the owner has a mortgage? It does not automatically mean the tenancy is impossible. It means priority and collateral value must be checked before funding. If a prior mortgage, other tenant claims or taxes could absorb sale proceeds, a future deposit refund may be at risk even when the landlord promises repayment. Ask for current official records close to signing and again before transferring the balance on move-in day.
The HUG Ansimi Jeonse application offers available property-price/deposit-risk tools, registered-right information and landlord/guarantee checks under applicable access conditions. It can help identify red flags; an app screen is not a guaranteed deposit refund or a substitute for a lawyer's priority check.
Example: A renter is asked to pay KRW 100 million as a deposit for a flat advertised below nearby prices. The owner refuses to share title/registered-interest evidence. The renter should not transfer that deposit merely because the listing is attractive. Request the records and independent assessment first.
2. Use a contract you can read and a clear payment sequence
South Korea's Ministry of Justice announced English, Chinese and Vietnamese translations of the standard residential lease contract on 10 March 2026. Use the standard-contract topics as a checklist even where the seller offers a different form. A translated reference is not proof that every English phrase supersedes the binding signed Korean document.
Before signing, insist that the agreement clearly specifies:
- Full names and identity of landlord/tenant, exact property and landlord account/authorisation.
- Deposit, monthly rent, management/maintenance charges, utility payment, contract term, renewal and early termination.
- Dates and recipients for reservation payment and final deposit, plus receipts and what happens if title or guarantee conditions fail.
- Who pays for repairs, unpaid utility arrears and end-of-lease cleaning, and what evidence supports deductions.
- Conditions for returning the full refundable deposit, handover of possession and what happens when the landlord fails to pay at expiry.
Ask for an explicit right to cancel or defer the final payment if a materially different title/priority problem is discovered before handover. Have an independent qualified reviewer check that clause; do not count on it merely because an agent verbally agreed. A lease with signatures is not the same as a guarantee by the government.
3. Understand three different tenant-protection steps
Official Korean guidance distinguishes (a) obtaining possession, (b) registering the residential move/foreign-resident address as legally applicable, and (c) getting a contract's fixed-date stamp (확정일자). These steps can determine whether a tenant has enforceable rights against a later buyer or priority over some creditors.
For a qualifying residential lease, Korea's official Easy Law guide explains that actual occupation plus required address registration generally protects a tenant against third parties from the following day; a fixed date helps establish preferential repayment against lower-priority creditors. It does not erase an earlier mortgage or guarantee that your deposit will be fully returned.
Foreign-resident caveat: Foreign registration/address-change procedures and their relationship to residential-tenancy protection require confirmation for your own nationality, visa and local registration office. Do not simply assume a foreign tenant must file the same form as a Korean national or that possession without lawful address records suffices. Ask the district/community service centre (주민센터) and immigration about the required records for your exact rental address.
The lease reporting clock is separate
The housing lease reporting system applies to covered places/contracts: a deposit above KRW 60 million or monthly rent above KRW 300,000, with reporting generally within 30 days of signing. The enforcement decree in effect from 1 October 2026 maintains these amount thresholds and specifies relevant regions/exclusions, including renewal without change to deposit/rent. A report with the proper lease document can deem the fixed date assigned; it does not replace possession and legally required address registration.
Practical sequence: Ask the local community office whether your property and lease are in scope; submit the written contract through the appropriate official housing-lease reporting route or authorised counter within the actual applicable deadline, keep the filing receipt, and confirm fixed-date assignment and your foreign-resident move/address record. Do not rely on a broker saying “we submitted something.”
Example: You sign a qualifying KRW 70 million-deposit lease on 5 November with a moving date in December. The 30-day lease-reporting clock is connected to the 5 November contract date, whereas possession/registration occur around actual handover. Ask the local office how those records interact rather than waiting until your December move to investigate the report.
A numerical risk screen before you hand over the deposit
A large advertised jeonse deposit can be risky even when the apartment looks beautiful. Seoul's official eight-point fraud-prevention guidance flags a jeonse-to-sale-price ratio above 80% as a danger signal, not a government-approved safety cutoff. It also tells renters to review the current registry for mortgages, provisional seizures and trust registrations, and separately check the building register and competing claims.
Illustrative comparison: The property would realistically sell for ₩350 million and the proposed jeonse deposit is ₩300 million. That is 300 ÷ 350 = 85.7% before considering the landlord's mortgage, taxes, other tenants' deposits, foreclosure costs or a fall in sale value. You could be lending almost the property's entire value to a private landlord. A cheaper wolse alternative with a ₩20 million refundable deposit and ₩900,000 monthly rent ties up much less principal but costs ₩10.8 million rent over twelve months before management/utilities. Neither scenario is a market quote; compare the deposit at risk and the nonrecoverable rent rather than declaring jeonse always cheaper.
A second danger: A building has multiple flats and the listing shows one unit's small mortgage. Other tenants' senior deposits, a trust structure or claims attached to the building can affect recovery. Obtain the correct title and building ledger, identify the legally authorised recipient, and ask an independent Korean legal/housing adviser to assess all prior-ranking claims before transferring the balance. A broker's phrase “no problem” is not the same as a clean title and recoverable deposit.
The HUG jeonse deposit-return guarantee product currently publishes up to ₩700 million in the Seoul metropolitan area and ₩500 million elsewhere as product deposit ceilings, and says the guarantee normally must be applied for before half of the lease period has passed. These are not guaranteed payouts or a promise that every home/foreigner is eligible: deposit, appraisal/valuation, mortgage priority, tenant status, landlord, property and actual underwriting all matter. If you have a two-year lease, half-term means you should not wait until the final year to even ask. Better: ask HUG about the specific property and your foreign-resident documents before signing, and do not wire the balance on the assumption it will be insured later.
Seoul also offers housing transaction advice for international residents. The city's help service can assist with understanding Korean rental paperwork and fraud risks; it is not itself an insurer or substitute for a specialist legal review.
4. Check deposit-return insurance separately
The Korea Housing & Urban Guarantee Corporation (HUG) offers a jeonse deposit-return guarantee subject to property type, price/deposit ratio, tenant eligibility, landlord situation, existing security and application conditions. Not every lease or foreign tenant qualifies. Verify the real eligibility, purchase channel, premium, deadline and exclusions before paying a large deposit.
HUG's own channel information distinguishes different application methods for apartment/officetel units depending on whether the landlord is a corporation or an individual. Using the wrong app route and failing to complete an application does not create coverage. Written approval/guarantee confirmation matters more than a broker's assertion that “HUG always insures this building.”
Ask in advance: “Can HUG or an authorised guarantor accept this exact apartment, landlord, mortgage priority, deposit amount and my foreign-resident status—and what must be completed before I transfer the final deposit?”
5. Move in, track payments, and prepare for move-out
At handover, verify the condition of floors, heating, ventilation, water, appliances and utility meters. Take dated photographs and a shared inventory, record keys and any defects. Confirm the identity/account receiving the final deposit after the required last-minute title check. Save all payments, the signed lease, report/fixed-date receipt and registry extracts.
Before giving notice or agreeing to a renewal, read the contract's deadlines and early-exit terms; a broker's promise of easy deposit return has no priority over legal rights and documented conditions. Request the return amount and settlement date in writing. Do not vacate or surrender the protective registration/possession position in a large-deposit dispute without case-specific guidance: doing so can affect priority. Ask a qualified Korean housing adviser or competent public service how to preserve your rights and pursue the landlord if repayment fails.
Before transferring a large deposit
Verify the registered owner, prior claims, the account receiving your deposit, the legal steps protecting repayment, whether a HUG guarantee is available for this home and the move-out/refund terms. If a major detail is unresolved, do not send a high-value deposit until the relevant documents or qualified housing advice establish the risks.
